Our client who was an employee of a contractor doing work at a mining site, suffered severe injuries at work, when, whilst working at the mining site, he fell off a stationery water tanker (belonging to another contractor) and fractured his leg in the process. Leon Martin Barristers and Solicitors claimed that our client’s employer as well as the owner of the water tanker were responsible for the accident and that the system of work of the employer was unsafe in the circumstances as well that the owner of the water tanker breached their duty of care to our client.

A District court action was commenced seeking damages for negligence against the employer and owner of the water tanker based on the fact that our client had suffered pain and suffering and loss of income as a consequence of the injuries. Leon Martin Barristers and Solicitors was successful in obtaining damages for our client in excess of one million dollars. Leon Martin Barristers and Solicitors had advised our client to reject an earlier offer by the Insurer which was significantly lower than the damages finally received.
